Welcome to ENDURA. These Terms and Conditions govern your use of endura.lk and the purchase of products, memberships and event registrations from us. By accessing or using our website, you agree to be bound by these terms. Please read them carefully.
This website is operated by ENDURA (Pvt) Ltd, of 34/3, Old Kesbewa Road, Raththanapitiya, Boralesgamuwa, Sri Lanka. In these terms, “we”, “us” and “our” refer to ENDURA, and “you” refers to the user or customer.
1. Use of the Website
a. You must be at least 18 years old to make a purchase or create an account on this website. Persons under 18 may use the website and participate in events only with the consent and supervision of a parent or legal guardian.
b. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
c. You agree to provide accurate, current and complete information during registration and checkout.
d. You may not use our website for any unlawful purpose, or attempt to gain unauthorised access to any part of our systems.
2. Products, Information and Pricing
a. We make every effort to display our products and describe them accurately. However, colours may appear differently on different screens, and we do not warrant that product descriptions, images or other content are entirely error-free.
b. All prices are listed in Sri Lankan Rupees (LKR) and are inclusive of applicable taxes unless stated otherwise.
c. Prices are subject to change without notice. Promotions and discounts are valid for a limited period and may carry additional conditions.
d. If a product is listed at an incorrect price due to an error, we reserve the right to cancel the order and refund any amount paid.
3. Orders and Payments
a. Placing an order constitutes an offer to purchase. A contract is formed only when we confirm your order and dispatch it.
b. We reserve the right to refuse or cancel any order, including for reasons of stock availability, pricing errors, or suspected fraudulent activity. If we cancel an order you have paid for, we will refund you in full.
c. You agree to provide valid payment details and authorise us to charge the total order value, including delivery charges and applicable taxes.
d. Card payments are processed securely by PayHere. We do not store your full card details at any point.
4. Shipping and Delivery
a. We deliver within Sri Lanka. Estimated delivery times are 1 to 3 working days within Colombo and suburbs, and 3 to 5 working days for outstation orders, calculated from the date of dispatch.
b. Delivery times are estimates and are not guaranteed. Delays may occur due to courier capacity, weather, public holidays or circumstances beyond our control.
c. Delivery charges, where applicable, are shown at checkout before you confirm payment.
d. It is your responsibility to provide a complete and accurate delivery address. We are not liable for orders delayed or lost due to an incorrect address, and re-delivery may incur an additional charge.
e. Risk in the goods passes to you on delivery.
5. Returns and Refunds
Returns, exchanges and refunds are governed by our Refund Policy, available on this website. Please refer to it before making a purchase.
6. Memberships
a. Membership benefits, duration and fees are as described on the membership pages of this website at the time of purchase.
b. Membership is personal to you and may not be transferred or shared unless we expressly permit it.
c. Membership fees are non-refundable once the membership period has begun.
d. We reserve the right to modify membership benefits, with reasonable notice to existing members.
e. We may suspend or terminate a membership without refund where a member breaches these terms or behaves in a manner that endangers or harasses others.
7. Events and Participation
a. Participation in ENDURA events, including runs, marathons and fitness programs, is voluntary and at your own risk.
b. You confirm that you are in adequate physical health to participate, and that you have consulted a medical professional if you have any condition that may be affected by physical exertion.
c. You agree to follow all instructions given by event officials, marshals and medical staff.
d. We reserve the right to refuse entry, or to remove a participant from an event, where the participant’s conduct poses a risk to themselves or others, or where event rules are breached.
e. We may postpone, reschedule, alter the route of, or cancel an event where necessary for reasons of safety, weather, public health, or the requirements of any authority. Our obligations in that situation are set out in our Refund Policy.
f. Unless you tell us otherwise in writing, you consent to photographs and video recorded at our events, in which you may appear, being used by ENDURA for promotional purposes.
8. Intellectual Property
a. All content on this website — including text, images, logos, graphics, designs and layout — is the property of ENDURA (Pvt) Ltd or its licensors, and is protected by applicable intellectual property law.
b. You may not copy, reproduce, distribute, modify or commercially exploit any part of our website or product designs without our prior written consent.
9. Limitation of Liability
a. To the fullest extent permitted by law, ENDURA (Pvt) Ltd, its directors, employees and partners shall not be liable for any indirect, incidental, special or consequential loss arising out of your use of this website, our products, or participation in our events.
b. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud, where such exclusion is not permitted by law.
c. Our total liability in respect of any order shall not exceed the amount you paid for that order.
10. Third-Party Links
Our website may contain links to third-party websites. We do not control and are not responsible for their content, products or privacy practices.
11. Governing Law
These Terms and Conditions are governed by the laws of Sri Lanka. Any dispute arising in connection with them shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
12. Amendments
We may modify, update or replace these Terms and Conditions at any time. Changes take effect when posted on this page. Your continued use of the website after changes are posted constitutes acceptance of the revised terms.
